Claiming child taxes illegally?

my stepson has lived with us for 6 weeks his mum is still claiming child tax benefits for him ,we have sent in all the forms for child tax and child benefit .we are stuck until she tells them he no longer lives with her ,his name is on the electoral roll as living here and living with her .she refuses to give it up , what can we do .
